These General Terms and Conditions of Sale, hereinafter referred to as the “Terms and Conditions”, govern the sale of shoes, leather goods and accessories by MARCHE ROYALE PARIS, located at 94 rue Louis Ampère, 93330 Neuilly-sur-Marne, France, through the website www.marcheroyaleparis.com.
They apply to all orders placed by a consumer, hereinafter referred to as the “Customer”, on the MARCHE ROYALE PARIS website.
By placing an order, the Customer fully and unconditionally accepts these Terms and Conditions.
The prices of our products are displayed in euros, inclusive of all applicable taxes, including VAT and any other taxes applicable on the date of the order, unless otherwise stated.
Processing, delivery and shipping costs are not included in the price of the products unless otherwise indicated. Their amount is displayed to the Customer before the order is finally confirmed.
When an order is delivered to a country outside mainland France, the Customer is considered the importer of the products concerned.
Customs duties, local taxes, import duties, handling fees or other charges may be payable when the parcel arrives in the destination country. These duties and charges do not fall under the responsibility of MARCHE ROYALE PARIS.
They remain entirely the responsibility of the Customer, who is responsible for all declarations and payments required by the relevant authorities and organisations in their country. We recommend that Customers contact their local customs or tax authorities before placing an order.
All orders, regardless of their origin, are payable in euros.
MARCHE ROYALE PARIS reserves the right to change its prices at any time. However, products will be invoiced at the prices applicable when the order is confirmed, subject to availability.
The products remain the property of MARCHE ROYALE PARIS until full payment of the purchase price has been received.
Once the Customer, or a third party appointed by the Customer, takes physical possession of the ordered products, the risk of loss or damage passes to the Customer.
The Customer may place an order:
On the website: www.marcheroyaleparis.com;
By telephone on +33 6 70 94 45 91, from Monday to Saturday, between 9:00 am and 6:00 pm, excluding French public holidays.
Before confirming the order, the Customer must verify the accuracy of all information provided, including the selected products, quantities, sizes, colours, billing address and delivery address.
Contractual information is presented in French and will be confirmed no later than when the order is validated.
Confirming an order creates an obligation for the Customer to pay the stated price.
Once the order has been validated, the Customer will receive a confirmation email summarising the products ordered, their prices, delivery charges, delivery address and the main details of the order.
MARCHE ROYALE PARIS reserves the right not to register a payment or confirm an order, particularly in the event of:
A supply issue;
A product being unavailable;
Incomplete or incorrect information;
Suspected fraud;
A payment incident;
A previous dispute concerning payment for an order;
Any difficulty concerning the order received.
If MARCHE ROYALE PARIS cancels an order that has already been paid for, the amounts collected will be refunded to the Customer.
Our products are offered subject to availability.
Availability information displayed on the website is provided for guidance only and may change before the order is finally confirmed.
If a product becomes unavailable after the order has been confirmed, MARCHE ROYALE PARIS will inform the Customer as soon as possible.
Depending on the available options, the Customer may then choose to:
Wait for the product to be restocked;
Select another product;
Cancel all or part of the order and receive a refund for the corresponding amounts.
Payment for the order must be made using one of the payment methods offered on the website at the time of purchase.
The Customer confirms that they have the necessary authorisation to use the selected payment method.
Payment is due in full when the order is confirmed. The order will only be considered final once payment has been approved.
MARCHE ROYALE PARIS reserves the right to suspend or cancel an order in the event of a declined payment authorisation, failed transaction, suspected fraud or incomplete payment.
Banking information provided during payment is processed by the secure payment providers available on the website. MARCHE ROYALE PARIS does not store the Customer’s complete bank card information.
MARCHE ROYALE PARIS delivers throughout mainland France and to many international destinations.
Delivery availability for the Customer’s destination, together with the applicable charges, will be displayed during checkout.
Delivery is free within mainland France for all orders with a value of €200 or more.
For orders below €200 and for international orders, delivery charges are calculated and displayed before the order is finally confirmed.
Orders are prepared from Monday to Friday, excluding French public holidays. Orders placed during the weekend or on a public holiday will be processed from the next working day.
Delivery times displayed at checkout are estimates only. They may vary depending on the destination, the selected carrier and any applicable customs procedures.
Where this service is provided by the carrier, the Customer will receive a tracking number or link allowing them to follow the delivery of their parcel.
MARCHE ROYALE PARIS is responsible for the proper performance of the order until the parcel is physically delivered to the Customer or to a third party appointed by the Customer, except where the Customer independently chooses a carrier not offered by MARCHE ROYALE PARIS.
The Customer is responsible for ensuring that all delivery information provided when placing the order is accurate and complete.
MARCHE ROYALE PARIS cannot be held responsible for delays, failed deliveries or returned parcels resulting in particular from:
An incorrect or incomplete address;
An error in the recipient’s name;
The recipient being absent;
Failure to collect the parcel within the period specified by the carrier;
An unjustified refusal of the parcel by the Customer.
If the parcel is returned to MARCHE ROYALE PARIS for one of these reasons, the Customer may be charged the cost of any new delivery.
When receiving the order, the Customer is encouraged to check the external condition of the parcel and the conformity of the delivered products.
If the parcel is open, damaged or shows visible signs of deterioration, the Customer is encouraged to make clear and detailed reservations with the carrier and contact MARCHE ROYALE PARIS as soon as possible.
The Customer may be asked to provide photographs of:
The parcel;
The shipping label;
The internal packaging;
The product concerned;
The defect or damage observed.
Making reservations with the carrier does not affect the Customer’s rights under the applicable statutory guarantees.
In accordance with the French Consumer Code, the Customer has 14 calendar days from the date they receive the order to exercise their right of withdrawal without having to provide a reason.
Where several products from the same order are delivered separately, the withdrawal period begins on the date the final product is received.
To exercise the right of withdrawal, the Customer must notify MARCHE ROYALE PARIS of their decision before the end of the 14-day period by means of a clear and unambiguous statement, including by email or letter.
The request must include:
The Customer’s full name;
The order number;
The product or products concerned;
The date the order was received;
A clear statement that the Customer wishes to exercise their right of withdrawal.
The Customer may also use the standard withdrawal form provided at the end of these Terms and Conditions.
After informing MARCHE ROYALE PARIS of their decision to withdraw, the Customer has a further 14 days in which to return the products concerned.
Returned products must:
Be unworn and unused;
Be clean and in their original condition;
Show no signs of wear, damage, excessive creasing or alteration;
Be returned with their original labels, accessories and packaging;
Be placed inside suitable protective outer packaging.
Shoes must only be tried on indoors, on a clean and soft surface, to avoid marking or damaging the soles.
The original shoebox must not be used directly as the shipping box. It must be placed inside a cardboard box or another suitable protective outer package.
Shipping labels, adhesive tape or writing must not be placed directly on the original shoebox.
The Customer may handle and try on the products only to the extent necessary to determine their nature, characteristics and fit, in the same way as they would in a physical store.
The Customer may be held responsible for any reduction in value caused by handling beyond what is necessary to assess the nature, characteristics and fit of the product.
Return shipping costs depend on the reason for the return.
When the Customer exercises their right of withdrawal because they have changed their mind, selected the wrong size or no longer wish to keep the product, the return shipping costs remain the Customer’s responsibility.
The Customer is advised to use a tracked and, where appropriate, insured delivery service and to keep proof of postage until the refund has been completed.
MARCHE ROYALE PARIS cannot be held responsible for parcels that are lost, damaged or incorrectly delivered during a return arranged by the Customer.
If the Customer receives a damaged product, a defective product or a product that differs from the one ordered, they must contact MARCHE ROYALE PARIS as soon as possible before returning it.
The Customer must provide photographs showing the product, its packaging, the shipping label and the defect or damage concerned.
After reviewing the request, MARCHE ROYALE PARIS will provide the Customer with the appropriate return instructions.
Where the return is caused by an error attributable to MARCHE ROYALE PARIS or by a recognised product defect, reasonable return shipping costs will be covered by MARCHE ROYALE PARIS.
Where the right of withdrawal has been validly exercised, MARCHE ROYALE PARIS will refund the Customer the amounts paid for the returned products.
The original delivery costs paid by the Customer will also be refunded up to the cost of the least expensive standard delivery method offered when the order was placed.
Additional costs resulting from the Customer choosing an express, priority or more expensive delivery service will not be refunded beyond the standard delivery rate.
Refunds will be issued using the same payment method used for the original order, unless the Customer expressly agrees to another method.
MARCHE ROYALE PARIS may withhold the refund until the returned products have been received or until the Customer provides evidence that they have been dispatched, whichever occurs first.
After the refund has been issued by MARCHE ROYALE PARIS, additional processing time may be required before the funds appear in the Customer’s account.
MARCHE ROYALE PARIS may reduce the refunded amount where the product has lost value as a result of handling beyond what was necessary to establish its nature, characteristics and fit.
A reduction may apply in particular where the product:
Shows signs of wear or use;
Is stained, scratched, damaged or altered;
Has marked soles;
Is incomplete;
Is returned without its accessories;
Is returned with a damaged original box;
Has been handled beyond a reasonable fitting.
Any reduction will be determined according to the actual loss of value observed and in accordance with applicable law.
Customers wishing to receive a different size, colour or model should contact Customer Service to confirm the availability of the requested product.
Depending on stock availability and the circumstances of the request, MARCHE ROYALE PARIS may:
Arrange an exchange;
Ask the Customer to return the original product for a refund and then place a new order.
Any price difference and applicable delivery or return charges will be communicated to the Customer before the exchange is confirmed.
For returns made from outside France, the Customer is responsible for correctly completing all required customs procedures and documentation.
The parcel must be clearly declared as “Returned Goods” and must include the original order number and any information provided by Customer Service.
MARCHE ROYALE PARIS cannot be held responsible for delays, customs duties, taxes or handling fees resulting from an incorrect or incomplete customs declaration.
Customs duties, taxes or handling charges incurred because of an incorrect declaration may be deducted from the refund, except where the return concerns a defective, damaged or incorrect product attributable to MARCHE ROYALE PARIS.
Products purchased during a sale, as part of a promotional offer or using a discount code are covered by the same right of withdrawal as products purchased at the regular price.
The refund will be calculated on the basis of the amount actually paid by the Customer after the discount was applied.
Products sold by MARCHE ROYALE PARIS are covered by the statutory guarantee of conformity provided by the French Consumer Code and the guarantee against hidden defects provided by the French Civil Code.
The consumer Customer benefits from the statutory guarantee of conformity where a lack of conformity existed when the product was delivered and becomes apparent within the period provided by law.
In the event of a lack of conformity, the Customer may request that the product be brought into conformity through repair or replacement, subject to the conditions and limitations provided by applicable law.
Where repair or replacement is impossible, cannot be completed within a reasonable period or causes significant inconvenience, the Customer may be entitled to a price reduction or cancellation of the sale under the conditions provided by law.
The Customer may also rely on the guarantee against hidden defects where the product has a hidden defect that makes it unfit for its intended purpose, or reduces its usefulness to such an extent that the Customer would not have purchased it, or would have paid a lower price, had they been aware of the defect.
In accordance with the French Civil Code, the Customer may choose either to return the product and receive a refund of the purchase price or keep the product and receive a partial refund.
MARCHE ROYALE PARIS cannot be held responsible for damage resulting from improper use, inadequate care, use contrary to the product’s intended purpose or normal wear and tear.
Photographs and descriptions displayed on the website are prepared with the greatest care. However, slight variations in colour may occur depending on the screen used, lighting conditions, the nature of the leather or the handcrafted nature of certain finishes.
Such natural variations do not necessarily constitute a lack of conformity.
MARCHE ROYALE PARIS cannot be held responsible for delays or failure to perform its obligations resulting from an event of force majeure within the meaning of French law and case law.
Depending on the circumstances, force majeure events may include natural disasters, fires, floods, epidemics, general strikes, conflicts, disruption to transport networks, major communication system failures or administrative decisions preventing performance of the order.
Personal data collected when an order is placed is used to manage orders, payments, deliveries, returns and customer relations.
The conditions governing the collection, use, retention and protection of personal data are explained in the Privacy Policy available on the website.
